I. REGULAR MEETING - GENERAL FUNCTION 

August 23,2006 - 6:00 p.m. Location:

1. Ms. Diana Bass, Governing Board President, called the meeting to order at 6:00 p.m. 

Board members, constituting a quorum, were present; Ms. Bass, Mr. Planeta,'Mr. 

Mrs. Ramirez and Mr. Otterman. 

2. Pledge of Allegiance 

The Dysart High School JROTC Color Guard presented colors ad Ms. Diana Bass led the 

pledge of allegiance. 

3. Student AwardsIPresentations 

The Sun City West and Surprise Rotary clubs presented the Dysart Path to Premier 

Rotary Teachers of the Year awards to Ms. Linda Heck, Ms. HaIey Ward, Ms 

Terri Smith, Ms. Emily Nachtwey and Ms. Cindy Larson. Each teacher received a 

plaque and check for $500.00.

Agenda Form and temporarily suspend any Governing Board Policy with which

5. Reports of Representatives to the GG 

Dysart Education Assocjation (DEA) - Ms. Nikki Frye, DEA President, reported the DEA 

hosted two luncheons for new and returning teachers. In addition, Ms. Frye indicated the teacher 

organization is, thankful for the placement on the agenda of an item to discuss and take action on 

rescission of ~~oclamatidn 03-4704. 

Dysart Education Support Professionals (DESP) - No Report 

6. Board and Superintendent Update 

Govern~ng Board Update - Governing Board members commended teachers and adm~nistrators 

a job well done in preparing for the beginning of school. Teachers at new schools went above 

eyond the call of duty to get schools running and ready to receive students. In addition, D. L. 

ers-was recognized for their efforts in assisting the staff with getting the buildings ready for the 

first day of school. 

Superintendent Update - Dr. Maksimowicz, offered 111s sincere and personal thanks to staff for 

outstanding team effort to keep the school system moving. 

Staffing - Ms. Lynn Montanya, Executive Director of Human Resources and Legal Counsel, 

reported the district now employs 2,079 people; 546 new employees were hired for the 

school year. The District currently has six (6) openings in elementary schools, six (6) 

openings in high schools, 10.5 special education openings and 12 specials openings (music, 

PE, library etc).

Enrollment - Mr. Scott Thompson, Executive Director of Business and Auxiliary Services 

reported enrollment for the district in excess of 20,000 students for the beginning of the 

school year. The District is watching those schools with enrollment over 1,100; new schools 

opened with: 1) Parkview 580 students; 2) Sonoran Heights 643; 3) Western Peaks 846 and 

4) Valley Vista 1,095 

Construction - Mr. Thompson reported the new schools, Parkview Elementary and Valley 

Vista, had the normal opening day jitters and missteps. Mr. Thompson thanked D.L. 

Withers, the construction crews, Mr. Bob Young and Southwest Food Services for their 

contribution to a successhl start of the new schools. Mr. Thompson thanked his staff for 

going above and beyond the call of duty to work late hours and weekenas to ensure the new 

schools were ready for opening day. 

Transportation - Mr. Thompson reported difficulty with the transportation start. Mr. Chuck 

Moore, Durham Senior Vice President Western United States, addressed the Governing 

Board and apologized for the rough start. Mr. Moore wenton to say that Durham fell short 

of their commitment to the district and promised to fix Issues both short and long term. Mr. 

Moore reported the critical shortage of drivers (Durham currently has 28 openings) and poor 

communications with the district resulted in the problems, Mr. Periy DeWitt, a Durham bus 

driver, reported that 45 minutes between transportation tiers is not sufficient considering road 

closures and excessive traffic. 

7. Audience with Individuals or Groups 

Ms. Jane Hunter and Ms. Diane Pearlstein addressed the Governing Board with their concerns 

regarding the lack of planning and notice -to parents regarding the reassignment ti-om 

Kingswood Elementary to Parkview Elementary of students living in the unorganized territory 

north of Jomax and east of 1 63rd Avenue.

Mr. Charles Otterman, Governing Board Member, provided information regarding the value of the 

Governing Board supporting Policy BHC by referring employees calling the board with issues 

related to school or employment matters to the appropriate official chain of command. 

2. Gifted Program Development Update 

Ms. Juliann McCarthy, Assistant Director Special Education and Gifted, provided gifted program 

updates including the gifted identification matnx, staff development plans and Northern Arizona 

University (NAU) cohort for gifted endrrrsement. The plan presented is the result of work done by 

an advisory team consisting of teachers, adnlinistrators and parents. A copy of the presentation is 

available through the Special Education office.

Mr. Scott Thompson, provided information demonstrating the predicted shortfall 

in the District's inventory of schools as a result of the formulary process used by 

the Arizona School Facilities Board (SFB) In authorizing new schools.

Governing Board" 

After discussion, a motion by Lipscomb/Bass was entered to rescind Board 

Proclamation 03-4704, "Guidelines for Communicating with the Governing Board. UNANIMOUS 

Mr. Lipscomb suggested the verbiage contained in the proclamation, "Employees 

are hereby put on notice that " 1s too strong and causes reluctance on the part of 

staff to be seen talking urith board members. Ms. Nikki Frye, DEA President, 

confirmed the proclamation is confusing and results in not knowing when and how 

staff can talk to the board. Ms. Bass and Mr. Otterman reported they were 

unaware of staff anxiety resulting from the adoption of the proclamation.

IV.1 Action on Public Records Request Made by The Arizona Republic for 

Evaluations of Administrators 

After discussion, a motlon by OtterrnadLipscomb was entered to deny the 

public records request made by the Arizona Republic and Daily-Sun News 

for evaluations of administrators. UNANIMOUS 

Mr. Charies Otterman reported that as a board member he would respect 

employees by supporting the~r right to privacy with respect to confidential 

and private personnel evaluations. Mr. Bill Lipscomb provided to the board 

a copy of his argument against releasing performance evaluations of 

administrators. In addition, Mr. Lipscomb suggested Arizona Administrative 

Code R-25-105 limits access to personnel records of officials and agencies of 

the state of Arizona which could include school officials. 

Dr.- Kay Hartwell-Hunnicutt, Arizona School Administrators consultant and 

AG professor of education law, engaged by the district to review board 

pdlicy was available to answer questions. Dr. Hunnicutt reported the District 

has two policies, CBI and GBJ, addressing confidentiality of evaluations. In 

addition, Dr. Hunnicutt provided background information on two cases 

litigated by the attorneys for The Arizona Republic involving school districts 

and public records.

Under the 2 1" Century Community Learning Centers Grant the District will conduct after school, Saturday day classes 

and adult classes at Dysart High School, Dysart Elementary, El Mirage Elementary and Surprise Elementary schools. 

Up to two hundred (200) students and one hundred (100) adults will be served on each campus. A 90 minute block of 

academic and enrichment will fill the after school hours of the programs. 

A maximum of one (1) coordinator, thirty (30) teachers and fifteen (15) instructional assistants will be hired to staff 

the program at each site. One (1) site director will be hired at Dysart High School. 

SUMMARY AND RECOMMENDATION 

It is recommended the Governing Board approve the 2006 - 2007, 21" Century Community Learning Centers after 

school program for students and adults at Dysart High School, Dysart Elementary, El Mirage Elementary and Surprise

WHY: Family, school and community relationships are strengthened as cultural awareness, racial under- 

standing, inter-religious respect and gender equality are learned. These skills, coupled with improved 

leadership abilities that are developed from learning coinmunication and conflict resolution skills, 

lead to the reduced risk of violence, dntg abuse and other problem behaviors. Action planning gives 

students an opportunity to make positive changes upon returning to their schools and communities. 

Follow up activities at the local site level contribute to the sustainability of the skills and leadership 

capacity that is built during the camp experience. 

COST: The cost of Unitown 1s approximately $13,500.00 per camp. The cost encompasses transportation to 

and from the camp, lodging, meals for students and chaperones and the cost of camp staff. 

This is being resubmitted due to changes and additions to camp dates.

It is recommended that the Governing Board approve staffing ratios for the Before and After School programs 

operated by the Community Education Department. The staffing ratios are as follow: 

One 1.0 FTE Child Care Facilitator per site. 

One .75 FTE Assistant Child Care Facilitator for every 40 students at each site. 

One .75 FTE Child Care Aide for every 20 students at each site. 

By way of example, this means that if a site were to have 80 students, it would be automatically eligible for the follow 

staffing: 1 Child Care Facilitator; 2 Assistant Child Care Facilitators; and 4 Child Care Aides. Once enrollment is 

established, then community education will process a request for additional positions based upon these Governing 

Board approved position triggers. 

Community Education will have the option of hiring high school students to fill the child care aide positions. High 

School students working in these positions will be paid $6.50 to $7.00 per hour (depending upon education and 

experience). Student workers will not work more than 17.5 hours per week. Under these circumstances, these student 

workers are not eligible to participate In the state retirement plan and are not eligible for health or other benefits.

School Student.

It is recommended that the Governing Board approve the recommendation for award of contract #07-039-030 for 

Armored Car Services to Dunbar. 

On July 12, 2006 the Governing Board approved the issue and release of a miiltt-term Request for Proposal 

(RFP). 

The RFP was released on July 13,2006 to nineteen (19) vendors. 

Invitations were opened on July 27, 2006 and three (3) responses were recei~.ed. 

The District's evaluation committee consisted of Ms. Anita McLemore and Mr. Ken H~cks. Each offer was 

evaluated per the evaluation criteria set forth in the solicitation documents. The recornmendation is based 

upon that evaluation. 

Due to a number of large district accounts being transferred to the County Treasurer, the District has canceled 

the banking portion of the RFP. 

A best and final offer was issued on August 26,2006 and a response was received September I, 2006. 

This contract is for a period of five (5) years. 

It is anticipated that the District will spend approximately $63,000.00 towards this contract. 


It is recommended that the Governing Board approve the award of armored car services for the 2006-2007 school year 

to Dunbar.

d. the RFP process is more advantageous to the District because it allows all of the above to occur. 

It is further resolved that a multi-term contract is appropriate because: 

a. The estimated requirements of the District for employee background screening services cover the period of the 

contract; 

b. such a contract will senfe the best interest of the District by promoting economies in the procurement and by 

encouraging competition; and, 

c. if monies are not appropriated or otherwise made available to support continuation of performance in a 

subsequent fiscal period, the contract shall be canceled and the contractor may only be reimbursed for the 

reasonable value of any nonrecumng costs incurred but not amortized in the price of the materials or services 

delivered under the contract or which are otherwise not recoverable. The cost of cancellation may be paid from

To become a Highly Performing or Excelling School by 

2009. 

To continue to support increasing academic achievement 

of ALL students. Not just helping students move from Falls 

Far Below to Approaching or Meeting the standard, but 

also, moving students that are currently meeting the 

standard to Exceeds the standard. 

To reduce the number of behavior related referrals to the 

office. it is believed that there is a positive correlation 

between student behavior and student achievement. We 

want our students in class receiving instruction - not in the

Administration is recommending the appointment of Dr. Jon Bradley Johnson, Ed.D. for the position of Assistant 

Principal at Luke Elementary School. 

Dr. Johnson has twenty-nine (29) years of experience as a Principal/District Curriculum Director~Elementary School 

Coordinator for the Minneapolis Public Schools, St. Louis Park Public Schools and Northfield Public Schools in 

Minnesota. Dr. Johnson also has as one (1) year of experience as an Elementary TeacherIAssistant Principal for the 

Wayzata Public Schools and four (4) years as an Elementary Teacher for the Litchfield Public Schools in Minnesota. 

Dr. Johnson has a doctorate degree in Educational Leadership from Western Michigan University. Dr. Johnson's 

resume is attached for review. 

Dr. Johnson will be paid an annual salary of $82,591.43 (Step 10 for Elementary Assistant Principals on the 

Administrative Hiring Schedule). The annual salary will be prorated to his start date for the 2006-2007 school year.

reversed an otherwise poor climate. Climate surveys demonstrated the vast improvement 

in Wand parent attitudes, student achievement and confidence in the schooL

St. Louis Park Public Schools, St. Louis Park, Minnesota 

Served as principal m a "jirst ring* suburb of Minneapolis, Minnesota Cedar Manor had 

the highest poverty level and diversity in the djstrict. We instituted through parent and 

stafF involvement a new social skills program which improved student behavior and 

achievement. I developed a nomination proposal for the U.S. Department of Education 

Blue Ribbon Schools Program_ After a lengthy process, including a site visit from the 

U.S. Department of Education, Cedar Manor received recognition for excellence in 

education by being named a "National Blue Ribbon School" one of only five schools to be 

selected in Minnesota. Was principal representative on the district strategic planning 

committee.

During the 2005-2006 school year, a work group of teachers and administrators collaborated on an Internet Safety 

course for the Dysart Unified School District. Beginning with the 2006-2007 school year, it is recommended that the 

guidelines for Internet Safety Education be taught and followed in all schools.

As of September 5, 2006, the enrollment at Cimarron Springs had reached 1,163 students. The 40"' day enrollment 

projection for Cimarron Springs is 1,075. Due to special programs at Citnarron Spnngs, the school facility is 

physically unable to accommodate additional students and is at capacity. 

Administration is recommending the Governing Board take action to place a limit on grade level enrollment capacity 

at Cimarron Springs. The following is the grade level enrollment capacity. For those grade levels that are closed, 

hture enrollment will only be allowed if there is a decline in the number of students within a grade level. Some grade 

levels continue to have availability as of September 5, 2006. Students in those grade levels will continue to be 

accepted until the enrollment capacity has been reached.

When grade level enrollment capacity has been met, new enrolling student's school attendance area will be Western 

Peaks. En order to avoid sibling splits, a parent could -- at their option -- determine to move all their children to 

Western Peaks. Transportation will be provided for these students. A waiting list will be established and used to 

allow students to enroll should openings become available. Openings naturally occur when students withdraw from 

the school. 


It is recommended that the Governing Board approve placing a limit on grade level enrollment at Cimarron Springs 

Elementary School.
